I have been under TN for 12 years and my I-94 is going to expire by May of this year. I have a wife and a 2 yrs old daughter and they are under TD. We also have a 6 months ago son who is an USC.
I am going to have my company to file I-129 for me for TN extension, and my wife will file I-539 for herself and our daughter. This will be more costly than doing the self-petition at the POE, but by-mail seems will have a greater success rate for renewal. My questions are:
- If my company and I are going to file I-129/I-539 in late Feb, would it cause any trouble if we travel to Vancouver in March or April for short trip (1 week) ?
- If we got approval for my TN/TD extension by mail, can I still got rejected at the POE (Vancouver BC, one of the most notorious places for TN) when I cross the border since I have been in the US “too long” ? As I understand we still need to get our passport stamped with the new I-94.
