Entering the US with VWP/ESTA while R1 application is pending

I will be visiting my partner in NYC in the near future while I my application for a R1 visa is still pending.
is this possible or will it cause complications with the ESTA before the R1 application has been resolved?

all help and hints are appreciated.

An R visa is a non-immigrant visa, so your chances of getting in using the ESTA are pretty good, probably.
