My case is bit complicated my Husband came To USA on L1B visa in the mean while his L1b Visa was maxing out and his company filed for H1 (his GC was in progress) which got approved and I transferred from L2 to H4.
1. After I got H4 I travelled to India and Got my H4 stamped in 2011, But my husband never got stamped his H1.
Question: Since I had stamped my H4 visa last time and its renwed for second time now, I am planning to go to India , I'm I eligible for Visa waiver program since my prior h4 was stamped.(so say I am not eligible since my Husband has never stamped his H1).
Please clarify me.
