Hello all,
I am looking for some advice before I call the US consulate from Australia to get the details.
Here is the story. I received my visa via ESTA no problems. While I was in the US I was in fact arrested for having an argument with my girlfriend. When I was in the booking office I was told that the charges against me were for "assualt - misdemeanor". I was then taken to Jail and spent the night. I was then told that I would go to court the next day to find out if I was going to be prosecuted and charged.
The following morning they called my name and told me I was being released as the case was being dismissed and no charges were being filed against me. - I also assume that means no conviction.
My question is, will this affect me next time I try to apply for a VWP/ESTA? I have never been charged prior or been in trouble with the police prior. I am a 29yo professional working male.
I notice on the ESTA the only question related to arrests is "Have you ever been arrested or convicted for a crime that resulted in serious damage to property, or serious harm to another person or government authority?"
How should I answer this question? I would assume that my answer here would be no?
I am looking for some guidance and will be getting in touch with the US embassy, but in the meantime thought someone could shed some light here.
Thanks for taking the time to read.
EDIT - Just wanted to add that I was never arraigned - the case was dismissed before I ever went to court..
