  • ESTA denied - Considered as overstay while I got a visa extension accepted

    Hello,

For a one-week trip, in the coming months, we applied for ESTA. Mine was accepted, but my partner's one was rejected.
A few years ago, we lived in the USA, he had a 6-month B2 visa and applied for an extension until the day of his return flight. He received the updated I-94 several months later, with permission to stay until the day he flew home. So, everything was legal.
Is it possible that this authorization was not forwarded to the immigration authorities? What recourse is available to correct this error?

    Thanks for your help!

I don't think there is anything to do other than to apply for a B2 visa.

This is my personal opinion and is not to be construed as legal advice.

Having an ESTA application denied dueto being considered an overstay, despite receiving a visa extension, can be frustrating. It’s essential to clarify your immigration status and ensure all documentation is accurate and up to date. Consulting an immigration attorney may help address the issue, allowing you to understand your options and improve your chances for future travel to the U.S.
