    Hello,

    I applied for and was denied a student visa in 2004 because the consular officer didn't believe I had strong enough ties to my country that would make me want to go back to it after my studies. Anyway, I'm trying to go to the US under the Visa Waiver Program. My country is one that is under the VWP and I have the right passport required. The only problem is the previously denied student visa.

    I've read that if you have been refused a visa in the past, your ESTA will most likely be denied


    As well as if you were denied a visa under INA 221(g), but I don't fall under that category


    Does anybody know what the likelihood of my ESTA being denied is based on what I've said? I unfortunately did not think it would be a problem and already bought my tickets for September 27th, 2012. I've tried making an appointment (even paying the 14$ fee before seeing the calendar of available dates), but it tells me that I can only make an appointment if my ESTA has been refused. Even when I prefer to just click "Next", when I enter my passport number and birthdate, the visa appointment site tells me those ID are already in the system (which I'm guessing to be my ESTA application that is pending) and refuses to let me book an appointment.

    I really didn't think anything of it. Any insight would be greatly appreciated. Thanks.

    Just replying to myself so that this topic can help others in the future. Yes, ESTA will be refused (since they don't ask which visa was refused when you say yes to the question) because of previously denied visa.
