  • Questions on Visitor visa approved only for a month

    Hi,

My mother with a 10 year visa entered USA on 1/7/2005. She had the I-94 till 7/6/2005.

We applied for an 6 month extension till 1/5/2006. But the INS gave only one month extension till 8/7/2005.

She was planning to return on 8/31/2005 and has confirmed ticket.

    Questions are:

    1. Can we apply again for another month of extension?

    2. Does the 10 year visa get cancelled if the 2nd extention is rejected?

    3. Will this cause any issue for a future visa or green card application?

    Thanks a lot in advance.

    Sanjay.

MY FRIEND, WHY DO YOU WANT TO TAKE CHANCES AND JEOPARDISE YOUR MOM'S 10 YR VISA. ITS NOT WORTH IT. I ALWAYS TELL MY FRIENDS TOO THAT ANY EXTENSION REFLECTS BADLY AND COULD POSE A PROBBLEM IN FUTURE.....IT IS ALWAYS NICE TO SEND YOUR MOM BACK FOR A FEW WEEKS AND CALL HER BACK......ITS ALWAYS SAFE TO DO THIS. I HAVE SEEN READ AND HEARD A LOT OF CASES WHEN THEY HAVE EXTENDED THEIR STAY AND THIS HAS POSED A HUGE PROBLEM FOR THEM ESP WHILE RENIEWING THE VISA ETC. ALSO SOMETIMES AT TEH POE THE OFFICE MAY NEXT JUST GRANT YOU A 3 MONTH VISA INSTEAD OF 6 MONTH!! SO THE BEST THING IS TO AVOID IT AL TOGETHER.!!

I agree with akbarmuradabadi that a second app for extension is strongly
not advised. If they wanted to give you more extension they would have
done it on your first app. And If a denial for the second app comes back after your first extension has expired, you may be considered out of status.
IF OUT OF STATUS FOR EVEN ONE DAY, YOUR 10 YR VISA IS
AUTOMATICALLY CANCELLED and you will have to apply for a fresh one
at your home country with a convincing explanation for your overstay of
      an EXTENSION.
      So, DO NOT DO IT.
