  • Help to get USA Visit Visa for I-130 beneficiary

    Hi,

Dear friends, i need your help to get USA visit visa. My case and some information is given below: Please do reply if you know something.

My wife is USA legal permanent resident since November, 2011. She gave birth to a baby girl in July, 2012 in USA. She applied I-130 petition on my behalf in August, 2012 & we received an acceptance letter from USCIS. Now, i want to go USA to meet my new born child and my wife.

My question is that, can i go to USA on visit visa after filling I-130 petition and what will be the procedure of visit visa? What documents are required of me and my sponsor? Which type of visit i should apply for (B2 or some other category)? How many month should i apply for (1 year or less)? What will be the strong reason for visit visa in my case? I have heared that usually visit visa can not be granted to I-130 petition.

    Thanks

You can certainly apply. The procedure is the same as everyone else, described at http://www.immihelp.com/usa-visitors-visa/

However, the chances of you getting the visitors visa is pretty minimal, as you are young and with the pending I-130 petition, you have already shown the immigrant intent which contradicts the purpose of visitors visa where you have to clearly show the non-immigrant intent.

Thank you so much for such valuable information.
Can you please guide me that what should be the strong reason in my case? Can i say them that "I have never met my new born child yet and i want to meet her and take care for sometime"? Any suggestion? How many months up to maximum should i apply for?

You have no strong reason for getting visitors visa.

The fact you have not met your child etc. is a strong reason that you will stay in the U.S. and not come back.
