  • is it luck to get vis

I dont know have words , how to ask, but let me explain my situation,
    my self business man,
    1. I have my retail shop since 1987, but due to lack of knowledge or........I did not show much income in my tax papers.(normally people dont want to pay a lot of taxes all over the world)
    2. last year in May, I applied for B1 visa, ground was to participate one Trade fair. But I used papper of my friends's export import company as an employee.
I showed invitation letter from oragainser, invitation letter was from hong kong office of oragisers.

I was rejected, I dont rember its was 214b or 221, becase at that time I did not nothing about usa visa rules.
    consulate asked me
    1. when I visted brazil as I had visa stamp of brazil in my passport. I was due to to go in june to Brazil. so I replied I am going in june.
    2. secondly he told me why I got invitation from hong kong consulate. they must have office in usa, I should get invitation from usa.
    3. so they rejected my visa.

I have now appt in sep 2005, I got invitation from orgainizer from usa, stating that we are interested to participate jewellery show as exhibitor.
    now my question is
    a. should I metion in d-156 about my business to as well as employee in my friend's company
    b. should I mention about my incomtax papers.
c.do you think, I should hide about my business, as my self also in import business as well as I have my retial shop since 1987
    d. I have my house worth of 15lacks,(on my wife's name ) my shop is on rent but worth, (goodwill more than 20 lacks)
    e.I have only son,
    f. my father alive, mother resting in heaven, we are four borthers and one sister.
should I show these family tie, will it be sufficent.

Please guide me. I would be highly oblised

You should only say one , employee or a businessman.

If you had shown yourself as a businessman last time,
    things would be easier now.
It is better to file as a businessman but
if you say this time you have your own business they will ask you for how long, then you cannot answer" since 1987" because last time you said
    you were an employee.

You could show yourself as an employee like last time.
Income question is the most vital; Give them a large salary figure
with proof (bank statements). Show as much as wealth
possible in terms of deposits, inheritance from parents, account
balances, your house papers and your shop papers. Get a CA to prepare an
asset statement for your family with a healthy Total Income figure at the bottom which the consular can see at a glance. With your house and your shop, you can easily get an asset figure of Rs 50 lacs, which is good.

Since your last I-t returns are not so good. Pay some tax and file
one now for the current year showing good income and show that first if
asked. The higher your income in India , the better your chances of getting the visa.

Also you may be asked about the company you work for.
Its operations, its turnover and a letter from your company
detailing your income, your job title and granting you leave.

This is only a suggestion. You are the best judge of your own
    circumstances. good luck.

dear sir, thanks a lot for your guidnce, I really apreciate, now questions will arise in consulate's mind
      1. if I show papers of shop, he will think who is handling shop
      2. secondly he will think, why I am working for some other company while I have my own shop
      3. if show high sellary this year, he will think, why I have not submitted Tax retun
      4. in my previous all return, my incom is from buinsess, not from sellary

And you know, one question in consulate's mind , REJECT the visa.
in my own thinking, I should not show my shop paper, usuall sellary around Rs72,000/ per anum.
regarding Good tie, I should show about my son, who is 18 years, my father 70 years, I have to come back for both of them, becase I need to get my son education, take care of my father in this age, then I can show my property assest by one C/A
if consulate ask me about my tax return, I can say that my income is taxable so I did not file return.

can you blv, one of my friend got visa , same like my case very easily in First attempt. On the Ground of Trade fair, I mean he applied that he is working for one jewellery firm and they are participating exhibiton.

      please comment.
      thanking you again

        you said the shop is rented and employed people do rent out shops;
        that is very acceptable.

72000/- per annum is too less. More important than family are your
income and your assets in India. If you want the visa, show
        reasonable income and savings or else wait till you have it;
        my advice.
