  • Who shall apply my parent's visitor visa? Me and my spouse are both on H1B.

    Hi,

I came to US on H4 visa and applied for H1B visa its been just six months since I have been working and now I plan to invite my parents to visit US. My spouse has been working here since appx. four years. Since its been just six months I don't have any W2 as of now, also do you think the fact that I came here on H4 visa and then applied for my H1B might create a problem at the time of my parent's visa interview? We have our savings in one account so what is the minimum balance that we need to maintain in order to sponsor their visa?

    Thanks

Even if you dont have W2 you surely would be having Pay Stubs for the last 6 Months. Ideally, if parents have enough assets of their own they should self sponsor it gives VO more confidence that parents are independent and have enough reason to come back. Also, bank balances are rarely checked, the ties, work wise, financial, family etc that your parents can demonstrate to return back to home country are more important.

This is my opinion not legal advice.

Thanks for your reply! My father is retired but I have an unmarried younger sister who is still studying in college. Also, our house is an asset that my parents can show as a strong ties to home country. They can say that we have a younger unmarried daughter so we are going to visit US just for one month. Do you think that should sound as a strong tie to the home country?
