*Initiation for Parents Tourist Visa* L1 under Exetension

Hi,

Requesting for advice on below situation,

I am planning to initiate tourist visa for my parents; My L1 Visa and I-94 is expired and under extension process; Received RFE so working on that; it might take another min 2 months for final decision; With this situation, will it be advisable to initiate my parents tourist Visa? I heard that if I send them invitation letter (explaining that I will take care of expenses while they will be in USA), there are chances for rejection due this situation. Kindly advice. Thanks!

If you had a valid I-94 you could have done it , but in your case advisable to wait for extension approval to go through before applying for B2 for parents. Technically your status validity will depend upon your extension request approval/denial. The VO might question or ask to provide proof of extension approval during B2 interview.
