Applying B2 visa for my husband without marriage certificate-URGENT

My husband wants to travel to US in B2 dependant visa.We dont have marriage certificate instead we got affadavit from lawyer.
Will it be OK to apply B2 dependant visa for him?Or do we need any other documents?I have B1visa and I will sponsor for his trip.
What are all the documents he will be needed at the time of visa interview?

dependent is F2 and so on, B2 is not dependent visa of B1.

B1 visa is business visa while B2 visa is tourist visa and must be applied independently.
