  • Parents revisiting U.S - please advise

    Hello,

My parents visited U.S the first time in 2005 and that time the Immigration officer gave them an I-94 with 1.5 years stay (I think instead of 6 months he might have wrongly changed the year on the stamp?) So my mom stayed for 1 year and 15 days and left. She did not come here in the last 7 years.

Now, she is coming here for a 6 month stay. Does the duration of stay the last time be a problem? I have not heard anyone getting a 1.5 year stay permission and I am still not sure if it was the officer's decision or made a mistake.

Will they question her this time? Please advise.

It was a mistake because visits are not granted for more than 6 months at a time.
It should have been brought to the authority's attention ( CBP ) when you noticed it.

Technically, she did not overstay so it may not come to anything.
But you never know, a strict officer noticing the anomaly at entry may
    cause problems

If you want to be doubly sure that she does not run into problems, talk to a good immigration attorney
    before she departs.

Hi, I am in the same boat. My MIL got 1 year i-94 before and she stayed here for 8 months. She is going to come in a few days. Can you please let me know what happened to your parents?
      Thanks for the help

That's definitely an overstay! Check with the US embassy/consulate. HOPEFULLY they'll be understanding...
