Visitor Visa B2 rejected for my in-laws - PLZ Need Help

  • Visitor Visa B2 rejected for my in-laws - PLZ Need Help

    Hi all,

    My mother in- law and father in law went to Hyderabad consulate for B2 Visa interview (interview was in Hindi) for the first time, got rejected

    VO: when ur daughter got married and went to US
    Ans: got married in june 2012 and went to US in July

    VO: What ur son in law do?
    Ans: He is XYZ working in ABC company

    VO: How many sons do u have?
    Ans: Have 2 sons and have business

    VO: why do u want to go to USA
    Ans: To visit my daughter and son in law and for tourism

    VO: Who is sponsoring?
    Ans: Son in law

    VO: show bank statement of your son in law
    Ans: bank statement was given to him

    After checking VO replied he has less income, and suggested to apply after 1 or 2 years and Visa got rejected and issued 214(B)

    Can someone please suggest me when can i re-apply again, can I change the consulate to chennai as my in-laws residence is in Karnataka
    Is it Ok to re-apply in a month and what can i make a significant change when i re-apply?

    BTW, what is your income?

    The denial could also be due to them suspecting pregnancy, because
    your parents want to go just 6 months after she left.

    Changing consulate won't work

      Thankf for the reply.

      Showed bank balance $10k. Initially submitted DS 160 in chennai and scheduled interview in HYderabad due unavailability of dates in chennaii. On the day of interview VO told them to re-submit DS160 in Hyderabad and were told to come back

        That is actually not enough.
        Did you not send any income documents?

        Is your brother in India? If he is earning very well, he could sponsor.
        What about the business your parents referred to?
        If it is doing very well, they could sponsor themselves.

          Yes I did send my income documents. I didn't tell my in laws to tak bank statement for interview since they don't maintain,
          Is it okie if they do show bank statement with sufficient balance. How much they need to maintain the balance?

          Yes they are doing well, they can sponsor themselves,

            What is your FIL's income from business that they show on tax returns?
            Income is important if they are showing self funding.

              both FIL 2L/annum and MIL 3L/annum on tax returns. If i reapply in a month what should i give the reason for rejection while filling the DS-160 this time and also is it Ok to show the bank statment now?

                Well, your in-laws income is not enough for self funding. Should be at least 10L (combined family) /yr.

                I fail to understand why the officer looked at your bank balance and not your Income tax return.
                Did you not mention your income on the I -134?
                You should not send a bank statement with only 10k in it .

                  I did show my pay cheque,
                  Ohh few of them said 10k wil be enough to get the visa,
                  Hmmm so now what should I do to make my case strong??
                  Thought of showing 10L in bank balance will it work?
                  And this time I wil not do sponsor.
                  Need suggestion plzzzz help.

                      Whats the urgency for a visitor visa? They can try their luck by applying again but in most likelihood if they go again any time soon the urgency will be very visible. They can try again after few months. I would suggest you follow as the VO suggested, that is file again after 1-2 Year.

                      Bank balances are not checked very frequently but if checked they would want to see regular paychecks coming in as well as decent balances. A transfer before visa interview will be easily seen so suggest not to do so. If you want to try again within a month Suggest they apply individually dont know if that will help.

                        No urgency, thought we can spend some time together
                        And as summer is coming up so wanted to visit few places, last summer my parents had come, this time I wanted my in laws to come,
                        But bad luck,,

                        Hmmm after one or two years dey may suspect that my wife will be pregnant and once again they may reject

                        Don't know when to reapply??

                        They don't hav any intension of staying here,
                        There sons, grand daughter, daughter, sists,bro, relatives all r in India,
                        Also have strong ties,

                        They will return back to India for sure
                        They just want to come for 15days,,

                        Ur suggestions will be appreciate,

                          Hi all,

                          Just to update on my inlaws visitors visa - they got visa on second time, attended interview feb last week

                          VO asked

                          1) why u changed consulate

                          2) where ur daughter stay

                          3) when she got married

                          4) how many days u will stay

                          5) will u stay in US only

                          Changes made from previous visa application was sponsorship. All the best for all . I think just need strong ties to home country will get the visitors visa

                            Congrats. Can you please elaborate what changes in sponsorship were made? Did you show them as self-sponsored or you send revised bank statements with more balance?

                              Yes changed the DS160 with self sponsorship- inlaws bank statement but VO did not ask for sponsorship. Hope this helps
