  • Need help on b-2 visa

    hello..

My mom and sister are planning to apply for visit visa(b2) to attend cousins marriage.Another strong reason for the visit is the poor condition of my maternal grandmother and the recent surgeries she had and with her age being in 80`s makes it difficult for her to travel, so basically its the only chance my mom will have to see her. my mom is a homemaker while my sister has a good job.

about the marriage: the ceremony is that of my mothers-sister daughter and it is the first marriage in our family in u.s.( going to b a hell ov a party) my moms sister has urged my mom to attend and take her chance by applying for visa. she has even filled a VERY strong letter of support to finance the entire trip. my moms other siblings and relatives are in u.s as well.

my father, me and my brothers are not applying.so my mom and sister are bound to come back...

there is this hurdle that my mom`s sister has applied for immigrant visa for my mom(f4) but in the light of the slow visa bulletin her case still has at least 5-6 years.

our financial condition here is good.

Now can you tell me what are the chances for getting a visa or is it a lost cause? is there some policy of not issuing visa to people with ongoing immigration procedures? what are the issue which can harm their chances? do you have any past records of such scenarios?what are the question they will come across? what document should they carry?

    need your help.thank you

Yes, an immigrant petition filed on the applicant's behalf usually goes against the grant of a B1/B2. As B1/B2 requires a non-immmigrant intent.
And one should not lie about such a thing in the application. They can cross check everything.

But it has been granted in some cases when the officer is convinced that the current visit is temporary.

    No harm in trying.
If you guys are well off, show self funding for the trip. That can make a big difference. No need for that strongly
worded letter. For that your dad must have good income . 1 lac /month from all sources should do it.
Usually they base this funding decision on the q,"What does your husband do and what is his income?".
They usually do not look at any documents.

If your dad's income is not that much, your aunt can sponsor with financial documents.
( I-134 and bank statements, tax returns).

About your sis, a lot will depend on what she is doing in India.
Working with a very good job can be a hugely positive factor.

THey usually do not look at any documents, but must take these
    just in case,

    1. Wedding card, an invitation letter from US .
    2. US passport copies of your
    inviting aunt.
    3. I-134 + financial docs of US aunt, if sponsoring. If your mother is self funding, that is not required.
    4. Income proof of your dad.
    5. Applying sister should take the documents of whatever she is doing ( student= enrolment cum leave proof; job=
employment cum leave letter with paystubs.)

PS. They will ask how long do they want to go for; should say like a month or so. Asking for long periods
    will be very negative.

    Good luck.

*How much is your dad's income roughly from all sources?

*What is your sis doing? working or student?
What kind of job/salary( govt/private/permanent/temp), if working?

THese two are very important questions.
Please answer them for more advice.
