Visitor Visa got rejected - Help needed - Highly appreciate your help!!

  • Visitor Visa got rejected - Help needed - Highly appreciate your help!!

    My husband sponsored tourist visa to my parents in year 2011 which got rejected.

    Reason:
    1) My dad has applied for H1B visa in 1998 which got rejected under 221g.

    2) Later dad and grandma applied together for visitor visa in the year 2004 which got rejected again

    3) Last time my mom and dad applied together for visitor visa in 2011 which got rejected again. Interviewer asked my dad to explain the reason for the H1B rejection. My dad told that he was given a pink slip but he doesn't know the reason for rejection.

    Interviewer rejected visa for my mom along with my dad with out asking any other questions.

    Now we are thinking to sponsor again,

    Please help me understand the best strategy to apply now,

    1) Is it better to apply individually for my mom and dad in one month gap, just to avoid my dad's visa history affecting mom Or is it better to apply together again.

    2) We bought a home recently is it a good reason to mention that during an interview

    Someone please clarify.

    Did he get any response after they gave the pink slip?
    Pink slip is for admin. processing. They get back to you with an approval or
    a reason for denial.
    Why did he not follow through with that ?
    Until he is clear about that he will keep getting rejected.

    Your mother can apply alone but they will ask her why she is going alone.
    Give some convincing reason but should not be followed immediately by dad applying again.

    She can mention the house, it is a not a decision making factor.
    More important is ; do you have any siblings in India?

      Yes I have one younger sister who is married and lives in London with her husband.
      To be more clear
      1) Dad applied for h1 on 10th march 1998 then they had written 221g and a date 9th April 1998 in his passport. They mentioned that they will contact him after 30 days and returned all the documents and passport.
      2) Since no one contacted after 30 days dad took another appt on 24th April 1998 (no fess was taken). This time they have typed 214b first, then they have striken that and wrote 221g and P6C and returned ppt and all the documents.
      3) Dad followed up again personally on 21st May 1998 as no one contacted him, this time he demanded the officer to give an explanation about his case status and for postponing month after month, this time the visa officer got offended and turned off the speaker and has returned his passport writting 221G and P6c but this time he has not given any of the documents back.

      Dad later has known that the US company who sponsored dad's job is blacklisted.
      This is all he knew about the rejection, but he never got an actual explanation from the officer why his visa has been rejected.

      In March 1999 dad went to singapore and returned back after staying there for few months.


      - What would be an convincing answer for my mother to tell if we apply just for her individually?
      - If the interviewer asks why she is applying alone can she mention genuinely about my dad's case showing his paaport and how that imapacted her visa when they applied together last time in 2011
      - Is there a way to find the H1b rejection reason applied in 1998?
      - Would it be helpful if we consult visa advocates to discuss about the case status?

        I looked up P6c; it is misrepresentation . I came thru several posts of P6c denial when the applicant is not given the details of
        the misrepresentation.

        It could have something to do with the company being blacklisted.

        You could talk to a good attorney before applying for your mother but
        note that a
        B1/B2 is a highly discretionary decision ; an attorney can only guide you regarding a B1/B2 .

        I suggest you go to someone with experience with Indian consulates.
        And take all your dad's h1b history with you.

        I can suggest a name but this forum does not allow attorney names.
