H4 to H1

Hi

My wife currently on H4 visa. she got H1 visa 2 weeks back. Now she is applying for jobs and also SSN is not yet applied. Her employer said that apply SSN once she got a job.

My employer is ready to file my H1 extension and for my wife H4 extension at a time. My employer doesn't know my wife got H1. If my employer applied extension for me & my wife (H4), My wife will be on what status ? H1 or H4 ?

First of all visa and status are too different things.

Once you are inside US, it is the status that matters . Status is stamped on the I-94 card.


If she has an H-1 approval from an employer , she should not get her H-4 status extended.
Only you should get your H-1 extended. She should file a change of status from H-4 to H-1.


What is confusing is your post is that you mention that she got an H-1 'visa'. She cannot get an H-1 visa sitting inside US.
Then you said she is looking for a job. How can she get an H-1
without a job?
Plus you mentioned 'her employer said'. So you are contradicting yourself.
