  • I-94 longer than VISA?

    Hi,

    I plan to stay in the USA for a period of 6 months (maximum allowed with the B2-visa). I already got my VISA but the validity of it is just for 3 months, I know the immigration post officer could issue my I-94 for 6 months but I'm afraid he will just limit it to the visa expiry date.
    The point is that my girlfriend is staying there with a J-1 visa (student) and I would like to spend with her the last 6 months of her stay, additionally my VISA has the annotation: "co-habitating partner of: her name"
    My questions is: Would any document help me to justify my stay during 6 months (or at least until she leaves the country)? and if so which documents should I ask her for (or her center)?

    If you tell them you have come to visit your girl friend for 5 months, they can give you a 6 month stay.
    There is no problem with that. Your purpose is already annotated, so there is no doubting that.
    Plus duration of stay has no relation with the validity of the visa.

    No special documents required. Just take an invitation from your girl friend that you carried to the embassy for visa.
    A copy of her visa and a proof of your job /student ties to your home country.

    Usually they do not look at any documents but no harm in carrying these, just in case.

      It will be no problem getting the copy of her visa and the invitation by her side, hopefully this is enough for the officer to let me stay at least until she leaves!
