DUI Arrest and Form I-539

I'm as a tourist in the US and I was recently arrested for DUI. I went to court and was not convicted, the verdict was PBJ for 1 day.

I am about to file for an extension of stay and I have to answer this question on form I-539:

"Have you ever been arrested or convicted of any criminal offense since you last entered the US?"

Obviously, I would like to answer "NO" to this question, but I'm not sure what to do.....

Was this a criminal offense? Can I not report this arrest?

What could happen if I don't?

I would really appreciate if someone could give me some advice on this matter.

As you were arrested, you have to answer 'YES' and just explain what happened.
