  • B2 Visa - Employment Issue

    Hi there, can someone help me with my situation?

    I want to attend my wife's graduation ceremony in May, 2013 and also complete some membership exams with a few prestigious organizations in the USA. These exams are not administered in India. For this, I need to go to the USA and stay with my wife for about six months. At present, she is doing her practical training on F1 visa. What would be the best way to show ties back to India?

    The company where I work now does not allow people for six months leave. I will have to resign if I need six months break. If I go to the VISA interview, the consular might ask for No Objection Letter from the company approving such leave, which is not possible. I am not able to show ties through employment.

    Any other way to deal with this situation?

    Thank for help.

    A mere mention of exams and a 6 month stay with your F1 wife in US will bring on a denial for sure.
    Even if you have plans to return , the officer will infer that you will stay with your wife and are not likely to return.

    Another major question they will ask is ;
    Is your wife returning after her graduation?
    If you will say she is going for OPT , they may suspect she has plans to stay in US and so will you.
    If she plans to return you may succeed.

    You can do this with 50-50 chance of success;
    Show purpose as attending graduation of your wife only. Ask for a stay of 10 days only.
    Get a leave for 10 days and get a letter from your employer.
    Do not mention exams and do not mention that you want a 6 mo nth stay.
    If your position and income with your company is good, you may succeed.

      Thanks Peace999, only ten days of stay will not be of any help. If a B2 visa is granted, how many months it is usually granted for? What if I show a job which I can say I will join after I come back to India after six months. That way I have something to show as my intention to come back to India. Any thoughts....thanks

        10 days is just for the mention.

        Even if they give you a single entry 1 yr visa ( min .) , The stay granted in US is not decided by the visa but by the inspector at the US airport.
        Where they easily give you 6 months.

        What do you mean IF you show a job----- You wil have to do that ;show an ongoing employed status in India-------------------- a must to get the visa.
