Returning back to US after a short Break in India, on B2 Visa

My MIL is here in US on B2 Visa since early Feb.

She has 10 Year Multiple entry visa valid until 3 years from now.

I94 is for 3 months expiring in early end of April (Her indian passport is expiring in June may be thats why she only got 3 months I94).

She wants stay in US for 3 more months.

Is there any risk returning to India in april before I94 expiry, stay 2 weeks in India to get indian passport renewed and come to US again?

Yes. since her purpose is purely pleasure, returning in 15 days will
definitely trigger interrogation and she risks visa cancellation /being sent back.

she should return only after a period of at least 5 months in India.


She could have renewed her passport in US ( they used to renew it for one year )
and then applied for an
extension of her stay . I think they may have stopped doing that
for people on visitor status. Check with Indian high commision if that is possible.

Reading online, it seems that CGNY does not renew passport for B2 unless it is real emergency. But i will try to call them.
