  • Grandmother overstayed Visa due to hip fracture.

    My elderly grandmother had a fall while staying in the US with us and fractured her hip. She had to get surgery and was unable to travel for months. This happened a few weeks before the 6 months deadline for her visiting visa. She returned to India in December but due to family conflict, she can no longer stay there. We need to bring her back to the US as soon as possible. She has no other relatives to take care of her in India. What do we need to do with USCIS regarding her situation?

    The right thing to do was to apply for an extension of her B2 when she was advised surgery.
    That way she would have been legal even after the I-94 expired.
    It was a genuine case for extension, so she would have surely got an approval for extension.


    It will be tricky now.

    1. By how many months did she overstay exactly? Meaning when did her I-94 expire?
    2. who are her relatives in US? On what visa statuses?
