    Hi,

    My in laws visitor visa rejected two years back at Mumbai consulate for 214(b). We are planning to re-apply now just for my mother-in-law first.

    1. in DS 160 - There is question about who is going to pay for the trip ? What should we answer here - Self or my name as my wife is on H4 and don't work here.
    First time we filled up as my name for paying the trip.

    2. This time we are thinking to apply only for mother in law. Is it ok?

    3. Also is it advisable to ask for congressman letter supporting her case? will it be any negative impact with such kind of letter?

    Let us know if any more information required.

    Avoid congressman letter.
    Self funding depends on your in-law's income at home. 10L+ /yr is safe for self funding.

    Can 's comment on the case without knowing the details;

    *can you post the last interview?
    *Also,
    -when did you come to US ?
    -Do your In-laws have any children in India?
    -What do they do ? retired or earning?
    -did you sponsor them last time?

      Last Interview was 2 years back. Asked few questions what they do, where are going ..Asked my mother in law what she does..

      We came here around 6 years back.

      My in-laws have 3 daughters in India.But not asked this question first time.

      Father - in law is working as accountant in small trust.

      Yes, I answered as myself for the question - Who is paying for the trip.

      According Mumbai Consulate website - details for 214(b) -

      The consular officer must be convinced that the applicant:

      1.Has a home outside the United States that he or she will not abandon;
      2.Is visiting the United States temporarily and will leave when the stated purpose of travel is complete;
      3.Is able to pay for the trip; and
      4.Meets the requirements of the visa type for which he or she is applying.

      The third point is "able to pay for the trip;" What should we answer for this question .. Their income is not high enough..but they do have property..

        Property does not count for funding.

        I-134 ( affidavit of support) acts as a counter for anybody not able fund their own trip.
        You will have to send that to your MIL with tax returns and bank statement.

        Also, MIL should give a solid reason when they ask her why she is going alone.

        Low income and no sons in India usually mean weak ties to India ( 214-b)
        but let us hope she gets a lenient officer.
