B2 tourist visa rejected for my sister and brother in law. Pls advise next steps

    Hi,

    I have applied for B2 visa for my sister and Brother in law. During the visa interview on 20th march 2013, they asked below questions.

    Which place are you going to visit in united states? to my sister
    Who is present there? - sister
    What are you doing - to my bro in-law
    what is your salary - to my bro in law
    how long are you planning to stay?
    he said 5 to 5.5 months.
    do you own a house? - to my bro in law
    he replied "We do not own a house. I own a land of 11 cents and my son is owing a house in the city"

    Hearing this VO rejected saying that we will not be able to provide visa this time. She gave a slip to sister and brother in law which states that the visa applicants did not show enough ties with the home country and did not develop a confidence that they will return back.

    My question is
    1. Is it necessary that the person who are traveling should definitely own a house on their name? What is the option if he is not owning the house?. As he mentioned, his son owns a house and they are stating together.
    2. I am planning to apply B2 for both of them again. Can I apply immediately again or there should be some time gap between back to back visa interviews?.
    3. Please give me some inputs on the mistakes we have done on the previous interview to correct ourselves which will increase our chances of getting visa the 2nd time.
    4. Can he tell that he owns a house as he is staying along with his son?

    Saying 5 to 5.5 months was wrong. All officers think that this is very long for a visit, even for retired people.

    Owning a house is not mandatory but if other replies are bad, then it can work in your favor.

    *What was their reply to work and salary?
    *What is your visa status in US?

      Thank you so much for the advice and reply. I should insist them to tell 2 months/1 month the next time when I apply. Please find my answers below.

      he told that he is working in Southern Cuisines and he is getting a salary of 1,20,000 Per annum.
      *What is your visa status in US?
      I applied for GC and received EAD card.

      Can I apply B2 again or is there a chance of rejection again?
      Can he tell that he owns a house next time as he is staying along with his son?

      I am confused with what options I have now. Pls advise!

        Low salary is another reason for denial.

        Applying quickly again is going to result in a denial.

        The reason is it shows desperation and secondly they will want to see a major change in situation
        ( eg more income, different purpose).
        Which is not possible in a short period of time.
        It is not necessary that they will ask for home ownership again.


        Maybe your sister can apply alone after several months , on your sponsorship.
