Primary Applicant on I 94 extension , Tourist travel allowed?

Hello,

My L1B expires on 25th July and I will be applying for I 94 extension.

During extended period, can I apply for mothers' tourist Visa and can she travel for 4 5 months to USA?

Will there be any problem in above approach?

yes, she can apply after you receive a new I-94.


However, visitor visa is totally visa officer-discretion-dependent.

It all depends on what family and work ties your mother has ;
*Does she have her husband and any children in India?
*IS she working with good income?

BTW, how long an extension are you seeking?
And do you plan to return to India after that?
These issues will factor in at your mother's interview.

I will apply for 2 year extension for L1 B.

My father passed away last year and mother who is a housewife stays with my sister in India.

sadly, visitor visa is very difficult for non-working widows with only son in US.

Do they check type of Visa held by sponsor? For example, L1 holder has to eventually come back and Tourist has to come back within 6 months?

L1s can extend status , change to H1 , find a GC sponsor etc. etc..
That is a secondary issue.

Primary issue is applicant's ties to home country ( spouse,children, job, income).
She has none of the 4.


One day when you are ready to return in a few months, and you can show a confirmed job from an employer in India
she may stand a slight chance.
