  • Its been 3 months on L1 Visa, can i apply B2 for parents

    I moved to US 3 months back on L1 visa, can i apply for B2 for my parents now ? As i did not file Taxes last year in US, as i just moved in. Also i will have bank statement for only 3 months.

    I was on H1B for 6years from 2000-2006 and i tried for my parents B2 in 2006 which got rejected due to insufficien paper work of their property documents. Will my old W2 forms help.

    Pls let me know.

    I think you should wait for a few months.
    They can be denied on this reason that you just left.

    Also, Since you won't have a current W2 ( old won't work), build up your bank balance
    if you will be funding their trip.

    Do they have strong income/ savings to fund their trip themselves?

      Thank you for the response.
      They are senior citizens. Yes they can afford the trip themselves. But how much is the suggested income/savings ? Would 10 times the trip expenses be ok ?

        Actually there is no official cut off for income or savings ; 1L /mo is considered safe.

        Are they retired receiving pension or just retired with savings? How much savings roughly.

          1. My dad was in business so don't get any pension, but they get some house rent around 1 lakh per year. The savings will be around 10 lakhs total in FD. Is it better for that they sponsor themselves or should i be sponsoring them ?

          2. If 3 months is not safe for applying, should i wait for another 3 months and apply ?

            With what you have mentioned, you should send an I-134 . They do not qualify for self funding.

            For that, I suggest you wait till you have filed one tax return and increased your bank balance.

            BTW, do you have any siblings in India?

                ok. good . child in India is good for your parents' app.

                However, I am thinking why they were denied back when you were on H-1. Usually property docs is never a reason for denial as
                there are more important factors. do you remember the interview what they were asked back then?

                  Actually in 2006 i applied without a translator. Though they know little bit of english they cannot talk fluently. The were asked to show my fathers transport business RC papers and he was not able to show all the documents. I dont think they asked if they had children in India.

                  If my company asks me to go back to India after 6 months i may not get a chance to even get them here. So I was thinking i will go ahead and apply after 3 months, and if rejected will apply again having a gap of 6 months from the visa date (if i am still here). Can i apply after 6 months of their denial ?

                    no need for translator, they can take an appointment in local language.

                    If that is the case, your dad can say that you are very likely to return in 3-4 months ,
                    so we want to tour USa while u r there.

                    you can reapply after 3 business days .

                      So even if they show couple of apartments on their name, the rents as income, and 10Lakhs /- as FD , its better that i sponsor them ?

                        For self funding one needs high income like 1L/month or high savings like 20L + ( no official cut off , but looking at posts these are safe figures).
                        property ownership is rarely asked for.
