  • B2 visa rejected for mom

    Hello Everyone!

    My mom B2 visa was rejected recently . Her details as follows

    OFC Appointment:14th May 2013
    Visa Interview: 15th May 2013
    Consulate: Mumbai
    Reason for Rejection: 214[B]

    Interview Questions:

    Why are you going ?
    Whom you are going to meet ?
    Are you traveling alone ?
    Why your husband not accompanying you?
    What your husband do?
    How many months you are planning to go?
    What visa your daughter is into?

    Her Background: She is employed and have accumulated leaves over the last couple of years. Her leaves are sanctioned by the employer. Her family is based here in India.

    I would like to reapply for her B2 visa again. Would need your valuable suggestion :
    - When Can I reapply for her B2 visa. Can she attend the interview after 15 days ? what is the normal time frame to wait and reapply?
    - What different shall I do this time so that the officer is convinced? Any supporting document to proactively show the officer?
    - What strong documents or evidence to show for 214(B) rejection. Please share with some of your experience and examples.

    You have posted the questions but not the answers your mother gave.
    Please post them so the reason for denial can be ascertained.

    One can apply after 3 business days but there should be something new in your situation when you reapply. Or they will deny you again.
    Documents are rarely looked at and decisions are mainly based on verbal answers and your DS160.

      Her questions were:

      Why are you going?
      Tourism purpose and visiting daughter and son -in-law

      How many months do you intend to stay ?
      5 -6 months

      Are you traveling alone ?
      Yes

      Why your husband not accompanying you?
      He is managing our small business.

      What business , monthly income from business , Hotel Sq foot ?
      small hotel / 2000 sq foot...

      On which visa your daughter entered US?
      H4.

      She specified that the son in law will be sponsoring her trip.
      VO did not see her any documents.

      Also, she is employed and have got a NOC from her employer. She has accumulated leaves over the couple of years. No discussion happened on her work.

      Please provide your valuable suggestion so that I can reapply her Visa again.

        Possible reasons for denial;

        *Mentioning 5-6 mnth stay is too long. That makes the officer think this; when she is willing to stay that long in US that means she does not really have compelling ties
        in India , so she could be a potential immigrant.
        *Secondly , she is going alone , and you are on H-4 ( non-working) , possibility of your pregnancy and baby care when she said 5-6 months.
        *Thirdly, you are funding her trip so she has weak financial ties to India. Business is small , income ( you have not mentioned) is not excellent I assume.

        For future;
        *What is your mother's and dad's combined family income in India? <5L, 5-10L, >10L+. ( yearly)
        *Do you have any siblings in India?
        *It is a personal q but important for the visa; are you actually inviting your mother for pregnancy/baby care?
        *Has she ever travelled abroad before?
        *When did you come to US?

          Here are the answers to your questions:

          For future;
          *What is your mother's and dad's combined family income in India? <5L, 5-10L, >10L+. ( yearly) .
          Around 4.5 L pa. i.e. Less than 5 Lacs.
          *Do you have any siblings in India? Yes. Sister and she is married
          *It is a personal q but important for the visa; are you actually inviting your mother for pregnancy/baby care?
          No . just want to spend some time in summers with her.
          *Has she ever travelled abroad before? No
          *When did you come to US? I have been here for around 3 yrs(2010).

          Just to clarify, she is a teacher by profession and we did mention the same in Form 160. This was not asked during her interview. She is also taking care of my grandmother who is dependent on us and staying with us.

          my question is :

          Does reapplying will create more issues for her? Or Or can we reapply with a reason of her job ?

            No issues if she reapplies. But reapply in a different manner.

            I was thinking they could self fund but with their income it won't work.
            Your hubby will have to send support papers like last time.

            Actually a major mistake was mentioning 5-6 mos of stay.
            I am wondering , how c'd she mention that period when she is working?

            In my opinion, reapplying quickly may not work.
            because she won't be able to show much change in her application.

            If she waits a few months like christmas time, applies with her husband
            for a period of say 4-6 weeks, it could work.

            That said, visitor visa decisions apparently not very rational. If you land with
            a lenient officer, and your luck is shining that day, anything can work.
