  • Duration of stay and gap between visits - B2 Visa

Apologize if this is answered already.
My mother has got 10 year multiple entry B2 Visa. In DS-160 application she had mentioned duration of stay as 1 month. Now she is travelling with me(H1-B, valid till Nov 2014) and my wife (H4).
I want her to stay with me for a duration of 5 to 6 months. And also i want her to return after few(?) months.
    My questions are:
Q1) What impact would it have on her re-entry if she stays for 5-6 months during her first visit. Will there be any problem because she had mentioned 1 month in her DS-160?
Q2) How long should she wait for the re-entry? Would reducing duration of 1st stay help?

No, the airport officers do not match what you wrote in DS 160. And once they gave her a 10 yr multiple,
that kind of flexibility is allowed.

That said, mentioning 6 months at entry is not really recommended. Even if they commonly grant 6 months to many visitors, this long duration coming from a parent
as a request can make the officer think she may not want to return.
4 months is a good duration to mention to the officer.

There is no set rule for the time interval between two visits. It all depends on each person's situation. For parents' casual visits,
5-6 months' gap is considered safe, when they are staying long durations like 4-6 months.
A quick revisit can be allowed if there is an emergent situation , and proof of it can be shown.

Thank you! That helps. To clarify little bit more, can you throw some light on following question:

If she says that she wants to stay for 4 months, are there still chances that they will put 6 month date on I-94? If yes, in that case do you still recommend she should return in 4 months or can she stay for 6 months?

This will help me a lot in tentatively booking her return flight and other planning. Again thanks a lot.

My personal experience; ONe time, Enroute from canada to India , I had to visit a relative in US for a week . I told the US officer 7 days and he gave me
        6 months.

So, it is very possible they will give her 6 months. And she can stay 6 months if they give her 6 months. But if she wants to return early,
she should keep this visit short.

My parents came in for 2 months and thats what they mentioned as duration of stay at the POE, they were given 6 months. This is usual for people entering US on B2, I think, unless there have been very frequent visits in the near past. She can mention 2 months and see if she gets an I94 for 6 months. If she doesnt, she can request the officer to extend it by some time.
This is my opinion. Not a legal advice

Yes, this is her first visit.

In case the officer gives her lets say a 3 month stay (because she says she wants to stay for 3 months), can she ask officer at the POE itself to change it? Or should it be done later through some application or something.

Also at POE should me and my wife (we are on H1B and H4 respectively) go along with my mother (who is on B2) to the officer?

They will not change what they stamped on your passport, unless it is an error. That is why saying 4 months is fine.

They take fingerprints and pictures, so they will attend to one person at a time.
But it does not really matter, It will not affect anything.

Is it safe travelling usa with b2 visa in a gap of 5 months after staying 6 months

I have been accepted on my first visit in USA with b2 visa for 6 months. unfortunately I have stayed full six months before returned back to my country. Now after exactly five months I am planning to re-enter USA with one of my aunt (my first visit was alone). I am around 25-26 years old. I am married and my wife will be back home. I am also planning to visit another country (hong kong) only few days before my departure for USA. it will be a great help if you could suggest me with the following queries -

                1. is it safe for me to visit now with my aunt?
                2. Will my 1st stay of 6 months going to play any negative role here?
                3. am I going to expect any question related to my first visit in USA (like why I stayed for 6 month, where did I stay etc)
                4. in case of any worse scenario - do I have any right/way to try to convince the officer that my intention is not to stay forever (which is fact as I have family back home and I do not have any first blood in USA)
                5. any further guidance/advice will be highly appreciated.

                thanks,
