  • B2 Visa Help

    Hi,
I have an interview on the 10th. I live in India and am currently studying here. I lived in America from 2003-2006 (3 years and 4 months). My parents and brother live in America and have been there for around 10 years. What questions would the VO ask me? What are my chances of getting a visa?

    AJ.

    You have to give more details;

What visa did you have when you lived in US ?
What visas do your parents and bro have ?

My parents and bro got their I-140 and the I-485 is pending. I'm 25 and still studying in India (currently enrolled in a course). Have a bonafide certificate from my university as well.

That means one of your parents was on H-1. Is that correct?

Why did you come back when they stayed there?

Are you staying alone in India?

You are not posting all the details. How can one advise on the basis of sketchy info?

I went to the US with my Mom and Bro in 2003. My Dad was on H1. The rest of us were on H4. Stayed there for 3 years and 4 months. Came back to India in 2006 for UG as out of state fees were really high (compared to India) for all the good colleges there. They stayed back because they have really good high paying jobs there. I am in India currently and live with my grandparents (Who might also accompany me. Grandfather is a retired High Court Judge and Grandmother is a retired Supreme Court Lawyer). I still have a semester to go and will be back to write my exams in October (can get a certificate from my college). Main reason as to why I want to visit now, is because I have some time off now. Didn't have this much time off since I came back to India. And also because my Grandparents are traveling and they can't do it by themselves.

Please let me know if you need anymore details.

          AJ.

In my opinion, your chances for a visitor visa are not good.
Because, your parents are converting from H-1 to GC, so naturally , in the eyes of the officer,
you will stay where the rest of your family is.
They will not give consideration to your remaining course work or your grandparents traveling alone.

That said, there is no harm in trying once, sometimes you get lucky with a lenient officer.
Ask for a short stay matching your time out from course work.

How much time will it take for them to get their GCs?

I think they will get theirs in the next couple of years (2 I think). Also, I cannot be added to their GC filing as I'm over 21. Will that help?

Yes, I know. There would not be any problem if you were not over 21.

No, their getting GC in 2 years won't make any difference to your B2 application.

Like I said, your chances are not great because your family ties are all in US.
But appear on the 10th , and see what happens.

Probably you already know that your parents could file for your immigration
under F2b after getting their GC, but that has several years of waiting .

If your B2 is denied, I guess the safest option for you will be finding an H-1b
sponsor in US. That is after you graduate in India.

Thanks for the help. Got approved. Came back from the Consulate 2 hours ago and checked the status online. It says "Administrative Processing". Should I go ahead and book my tickets or wait till I get the Passport?

Thanks. I was there for about 2 minutes. Was over pretty quick.

                      Me: Good Morning.
VO: Good Morning. Can I have your Passport.
Me: Sure. (Handed over the passport)
VO: Why are you going to the US
Me: I'm accompanying my grandparents to the US. We're going there to meet my parents.
VO: *With a surprised look* Your parents are in the US?
                      Me: Yes.
VO: What are you doing in India then?
Me: I'm studying in India and I live with my grandparents.
                      VO: What are you studying?
                      Me: YYYY
VO: Are you not done yet?
Me: Nope. I have a couple of exams that I have to write in November.
VO: So, you graduate in November?
Me: No, I graduate next year.
VO: When was the last time you were there?
                      Me: In the US?
                      VO: Yes.
Me: Lived there between 2003 and 2006.
VO: What do your parents do in the US?
Me: I tell him what they're doing now.
                      VO: What's their status?
                      Me: They are on EAD.
                      VO: What?
                      Me: I repeated myself.
VO: Can I see their documents?
Me: I handed over their document copies.
                      VO: How old are you?
                      Me: I'm 25.
VO: Do your grandparents have Visas?
                      Me: Yes.
VO: Your Visa is approved. Have a nice day.
                      Me: Thank you.
