  • B1/B2 visa cancelled under Sec 212(a)(7)(A)(i)(II)

    Hi,

I want to invite my parents to US on visiting visa. My parents have already visited USA three times earlier (they had 10 yr multiple visa - B1/B2) with my sister sponsorship in the year Jan’ 2001.

---> During their first visit, they stayed in US for 5 months only.

---> During the second visit, only my father stayed for 1 year. His extension was sent during 5th month of his stay and was approved in 6th month for 6 months. My mother stayed for 6 months only and did not apply for any extension.

---> During the third visit, my father and mother together stayed for 1 year. Their extension was sent on 12th month for 6 months and it was approved for that overstayed period of 6 months.

When they were coming for their fourth visit in the year 2006, their entry was denied and their visa was cancelled under the Section 212(a)(7)(A)(i)(II) at Chicago ORD airport and they were sent back to India.

In the year 2008, my sister sponsored again and my parents attended for B1/B2 visitor visa twice. But their visa was denied under the Section 214(b).

After that my parents did not attend for any visa interviews until June 2013. In June, I sent papers to my parents through my wife’s sponsorship for visiting visa, but their visa got denied again.

What should I do for my parents to get their visa again and they could come to US?

    Your advice is highly appreciated.

The reason for denial(s) is obvious. Probably to you too.

    Repeated Prolonged stays and extensions.

Visitor visa decisions are totally discretionary and once they are in their records
habitually abusing the visitor visa, there is nothing you can do .
You should have thought of this before applying for their extensions.

The only avenue now is getting them immigrant visas when either you (or sister) become a US citizen.
