My fiancée (naturalized U.S. citizen), and I (Permanent Resident in Canada with China passport) are going to get married. We are planning to register marriage in California, where my fiancée's families live and where she currently live. After getting married, she will move to Canada, where I live. Hence, I'm wondering do I need a K1 visa to enter U.S. or I can legally use my existing B1/B2 visa? I do not have any intension to migrate to U.S. and I would tell the truth if CBP asks the purpose of the trip.

K1 fiance' visa is not for you ; it is for people who wish to get a Green card based on marriage to a US citzn.
There is nothing illegal about getting married to a USC when on a B1/B2. What is illegal is
adjusting status to green card based on such marriage with a premeditated intent when entering as a B1/B2.
But the tricky part is;
Declaring that you are entering US to get married to a US citizen , may cause them to deny
you entry by thinking you will adjust status to a green card after marriage. even if you do not wish to.
You could just say you are visiting some friends/relatives. There won't be any later problems because
you won't be adjusting status to green card after marriage.Last edited by peace999; 07-10-2013, 08:37 PM.
