I am not divorced yet but I have a GF who came on a tourist Visa from Paraguay. Can we have her Tourist Visa changed to Student Visa? Also, once divorce is final in April 2014, can I get in trouble if we end up marrying together while she is on Tourist Visa or Student Visa?

When you enter US on a tourist visa with intent to become a future student,
you must mention this to the admitting officer and they will stamp
"prospective student" on your passport. Then you can easily change to student status , if accepted in a program and you have the funds.
Otherwise, I am not so sure she can do that. You should confirm.
At her interview for her green card thru marriage to you, they will interview each of you separately . If they feel she had premeditated intent to get married to you
when she entered as a visitor, she can be in trouble, not you. But in reality, if you marry a few months ( which you will) after she enters
and you hire a good attorney, it can be done.
Also note that even if she goes out of status , she can still adjust to a green card thru marriage to a US citizen.Last edited by peace999; 07-18-2013, 11:19 AM.
