  • B2 visitors visa rejected in Hyderabad consulate

    Hi Experts,
I need help in analyzing what went wrong in the visa interview.

Just a little back ground on myself,

I am on H1B visa and my wife is on H4 visa, i am sponsoring my Inlaws and planning for November because we are expecting a baby.
My Inlaws have a school which they own. its a big one in palkol. my father in law is the president and mother is law is vice principal.
My wife is the only daughter for them.

    The interview was a lady.

    Questions asked:

    1) Why are you going to USA?
to visit places and seeing my daughter and son in law.

    2) what does your son in law do?
he works in YYYY XX company.

    3) How many children do you have?
    only one daughter

    4) how many months are you going for?
    6 months

    5) how much do you earn in india?
    YYYY ZZZ lacs per year.

    6) what do you do?
( until now mother in law was answering. the lady says to my father in law to answer the question)
we have a school which we take care. my wife teaches in it and i take care of other stuff.

    7) in these 6 months who will take care of school?
there is an other person who will take care of the school.

Lady says , we cant give the visa at this point of time, sorry.

in the whole process they did not see any of the documents.my inlaws are 49 and 46 years old they look a bit young than normal....no gray hair.

can you please let me where could be the mistake?

They normally dont see any documents. Also, Your inlaws should not have asked for such long duration. Few very apparent negatives.

      1. Only daughter in US, they right away suspect pregnancy care and dont like that idea.
      2. 6 months period of stay. Should have asked for much lesser period of time. Requesting 6 Months again re inforces their conviction that they are coming here for helping in pregnancy. Also, if they can be away form their business/job/school for 6 Months what would prevent them for staying in US for longer periods?
      3. Your inlaws re inforced the point above by mentioning that no one will take care of their school in their absence. Means that school is not a strong tie to come back and can be kept closed for months/years.

You have to understand VOs are more interested in knowing ones reasons to come back to home country and apparently your in laws didnt provide any.

This is my opinion not legal advice.

if i reapply fr visa, and this time if i say 3 months? would there be a fair enough chance to get?
any kind of input is greatly apreciaed.

my inalws told the VO that the school will be taken care by principal.

If they immediately apply the VO will ask what has changed apart from duration requested since the last time and it will only show desperation to officers if you apply immediately. Again re inforcing the thought that they want to come for pregnancy alone.

The one thing that you can certainly try is that MIL tries for visa alone and FIL stays back. This has higher chances of approval in my opinion.

This is my opinion not legal advice.
