Visa refused...Getting Visa for my parents - PLEASE help !!!

  • Visa refused...Getting Visa for my parents - PLEASE help !!!

    I am in US on H1B for last 3.5 years. I have planned to call my parents on Visitor visa. In New delhi, their visa got refused based on 214(b) in May 2005. I am only son and .. have a married sister in India.

    My father got retired 2 years back and mother is housewife. Due to some reasons, my father pension has not started yet. But we have strong financial position. In assets, my father has 2 houses, 15 lacs Fixed deposit and LIC pension policy which gives Rs. 4000 every month.

    I asked my parents to try again on July 05. I have sent letter from Senator also 1 letter from myside (format from immihelp.com). But, officer asked again same questions :

    1. How many sons/daughter you have ?

    2. Pension.

    My parents presented letters and other details of our assets. But he did not pay much attention.

    Can someone help me ..what I need to do so that officer can overcome from 214(B) assumption. Pls. suggest. My family is going thru real mental pain specially parents...as they had lot of expectation regarding their visit..specially seeing my 4 year old son and 2 months old daughter.

    I have following things in my mind :

    1. I have asked my father to start some business ..he is going to register a financial company. – Will it help ?
    2. If I send my parents for separate interview..is it going to help..?

    I would really appreciate each and every suggestion. Also, let me know if you know abt any professional visa counselor services in new delhi area which might help.

    I was also in the same situation, my father has retired 2 years back and has low pension income and good property.
    But as he is retired the first question was pension and that screwed up the entire process.

    I tried for my Mom alone and she got Multiple entry visa and I am going to try for my father some time later.

    Starting a business may help them rather than saying retired and doing nothing.

      YES, I agree with Vanaja.

      And there is another factor of them not having any children living with them in India. Children are considered good ties that is why the consulars always ask about all children from parents.

      I think he should plan a business trip rather than a casual visit.
      I suggest he wait till next year till he has build up his company,
      payed some taxes and show a good balance sheet and a tax return.
      Then he should make a business trip to a european country or a south east
      country like singapore . And then he can apply alone for a visa based on a
      business trip to US related to his company.

      There are a couple of so called "visa consultants" but I have had a
      bad experience with one so I do not advise; they will just bilk you
      of your money.

        Thanks for reply. I agree with you but it is bit long way. Can you suggest anything else...which can bring them here in 6-9 months time period.

        1 more thing...will it be problem..if embassy notices that my father is in business for only 1 year.

        Or, shd I look for some existing company and let my father join like partner. I have few friends who owns their business.


        What do u think ?. Any other thoughts ?

          That is not a bad idea to join an existing business , but he should show good income from that. And making a business trip to another country
          before the US visa app will help.

            as I have read so many experiences here, I would suggest, let your mother(only) apply visa next time, your mother have to show that she will come back home becase she can not stay alone in usa with out her husband.

            consulate knows that its very hard for indian woman to stay far from husband, hope you got my point.

            if your father start business after retirment, (specially after rejections of visa) it looks little bit funny. you know what I mean,

            Just imagine if you were consulate, will you issue visa in such a case ?

            but your mother can get visa I am sure, then later your father will get once your mother returns back home

              And regarding visa for my MOM, my mom has to come back to India then only my father can go for visa interview ?? Is it possible to have some kind of overlap so that both parents can be here for some time.


              Does It means, in no way..parents can come together. Is there any other suggestion..I would really appreciate.

              Pls. help m with yr valued suggestions.

                i think what mahesh said is a good plan. i think your mother should first apply for the visa alone after getting it and after visiting US then only your father should apply , that way the consular will have something to see (indian ties in your family-mother getting back to india) .....and consular might be considerate about giving your father visa at that time.

                  be honest with you what my feeling is, so many people lie to consulate when they asked will they return back. every one says yes he will return. so its very hard for consulate to judge who is speaking truth.

                  so when you mom gets visa and she come back, it means she is honest so your dad will be honest. in that case defenetly he also will get visa.

                  my aunt,who was widow, she had only son, citizen of usa, was rejected three times. reason was she could not prove whether she will be back or no.

                  your mom has to show that she will defently return back just becase of your your dad. In Indian culture , wife or husband can not stay alone for long time.I am married, 45 years old, if my wife go to usa for 6 months or more than, then she can not stay there more than one month, she knows I need her and she needs me.

                  so your mom has to show this tie only.

                  hope your understand this. make an affadavite from your mom side stating that she will return becase shw can not stay away from her husband for long time so she will return back. this will help
