  • My Parents B1/B2 VISA Extension

    Friends,

    Currently I am in L2-EAD and my EAD & VISA expires by end of OCT 2013, my current employer processed H1B for me and I got my approval notice and new I-94 which has validity from Oct 2013 to Oct 2016. Currently my parents came to USA to my sister's home (SFO) and they are planning to visit me in first week of October 2013. I would like to apply for their B1/B2 extension (Their B1 I-94 expires in Dec 2013). My question is, " I have only approval notice, i don't have VISA stamped in my passport yet, can i apply for my parent's B1/B2 Extension just with my H1B approval notice? If I can apply, where should i apply? they have entered USA in SFO and did their immigration in SFO, I live in PA, should i send the extension request application(I-539) to California (SFO) or Pennsylvania, friends please advise.

    Your visa / I-94 status will have no bearing on their extension. And they will be applying for their extension NOT you.
    Meaning, if you are completing the I-539 for them , it should be like they are doing it themselves.

    And you can do it on-line, so it will go to USCIS, you won't have to worry about SFO or PA.
    The main thing is the address you will provide for them. You can provide the SFO address , because that's where
    they entered. the response will take 6-8 weeks or longer.
