  • Parents visitor visa rejected once, trying again - Plz help!!

    Hi,

    My parents B2 visitor visa got rejected on April'2005 considering them as potential immigrants since both their children are in US.

    We are trying again this Oct'2005. My father is a retired lecturer and my mom is a house-wife. They are somewhat aged. Even though my father tried to show all the property docs, house docs, bank balances, insurance policies, etc, and told the counseller that they have to take care of their aged mother and have several relatives in India and want to come back, the counseller claims that since both their children are in US and they themselves are somewhat aged and need their children's care, their chances of not returning to India are high.

    Added to this my brother changed his job during that time and so we provided my docs and i was the sponsor and we couldn't provide my brothers since we didn't have his latest ones. So, the couseller was a bit suspicious about that also.

    My husband is a greencard holder, is it helpful to submit his docs also to the counsellor this time, or is it a negative point to reveal this fact?

    I greatly appreciate your suggestions/guidance in this matter.
    We are so eagerly waiting for their visa approval, but scary of what happens this time.

    Your mother can apply alone first for a short stay of few weeks.That way your father will act as a tie to India for her. Your father
    can apply after she has travelled once. If they apply just like the first
    time, chances of refusal are high again because they have no real ties to India (children, job).

    Do not send your husband's green card documents: not relevant.

        Since both myself and my brother are on H-1B (tempory visa), can my parents stress on this point, saying that their children are on temporary visa and are planning to return in a short time, so there is no interest or possibility of them staying for longer time or immigrating.

          Like I said, reapplying together like the first time won't change anything. Reapplications are successful only if
          you present something significantly different than the first time.

          There is no point stressing on the point you mentioned;
          the consulars already know this. Their main issue is establishing ties to India
          which in your parents' case are largely lacking.

            If Mother goes alone for interview, what is the best explanation that she is going alone this time. Father is not accompanying her.

            Can we say clearly that due to 214(b). Or, give more practical reason like father is busy in house construction work etc.

            Suggest Pls.

              No, not 214b. Just give any reason that requires his presence at home.

                Experts..Pls. suggest what shd be the most complelling reason so that embassy do not think that we are doing just to avoid 214(b).

                  There are some cases where both retired father and house-wife mom have got vistor visa together even though all their children are in US, where they don't have real ties either.

                  what could have made them approve for few and not all? Is it a matter of luck or is it possible to provide some solid proof that convinces them in our situation?

                    Strangest reason I can think is that they are couples. - For some reason they think when ( either of the parent visitor applicants)one spouse is back in India they have better chances of returning back to India. Really strange I dont know what to say. Feel terible for my mom who just wants to visit her in US for 2 months being rejected 2 times on 214-B just because she is a widow - and without seeing all documents she took to the counter.. please help
