Visitor visa, I797 not yet approved

Hello,
I am planning to sponsor visitor visa for my in-laws. My 6 year H1B period completed in June 2013. I-140 for Eb2 is approved. So i am eligible for 3 year H1B extension. Application for H1B extension was received by USCIS in May. I-797 not yet approved.

Is approved I-797 required to sponsor visitor visa?

You don't actually sponsor the Visa, you only pay for their trip and you are the reason for their Visit (contact person). It is imperative that you be in legal status but that's all that is required.
