  • Visitor visa for Parents and Brother working as a freelancer.

    Hi All,

I am planning to bring my parents and brother on Visitor Visa.
    Here is the situation:

    Father: Age 60
Took voluntary retirement quite early in his career due to few health issues.
But works from home taking up small Accounting related jobs.
    Files Tax Return every year.

    Mother: Age 51
Runs a beauty parlor at home.
    Does not speak English.
    Files Tax Return every year.

    Brother:Age 24
Has done diploma in Computer Science and works as a free lancer online.
    Files Tax Return every year.

    Concerns:

    1. Can I send all three together for the Visa interview?
    2. Or Can I send parents together and brother separately?
    3. Given that mother does not speak english, does she have to be in a separate booth? or she can accompany Father/Brother/both in the english language booth?
    4. Incase of freelancing, brother would not have any kind of salary statements other than his online payment accounts where his money gets deposited.

Any suggestions on this would be of great help.

    Thanks,
    Vaibhav

You have not mentioned about your visa status and how long have you been in US?

    About your brother;

    *young
    *single( I assume)
*No stable job or business( freelancer)
    * not filing tax so his income would not be a lot.
*Going casually, not in relation to his work.
Please do not mind my saying, all the points above are NOT in his favor.
Because the officers are looking for some ties for him in India that will bring him back ,(spouse, c hildren, stable work) but he does not have any.
So he should not apply till he earns very well, has a stable occupation or can go in relation to his work.

about your dad and mother ; what is their combined income/yr roughly?

You sponsoring their visas and trips points to weak financial ties to home country. Whole family coming to US is again a negative as no family tie left back in home country. Your brother though filing income tax, if not having proof of income above 70-80 K INR per month is a negative as no strong job ties. Your praents not working is also a negative with no job ties to home country.

Answer this question to yourself : What would be valid reasons for your parents and brother to return back to the home country?

Once you get the answer collect proof of the same. And these are the valid reasons / proofs the VOs are looking for .

This is my opinion not legal advice.

sorry about the tax return/income comment about your bro.

In the end, the deciding factor for him will be his income. If he
is earning very well like 10-12 lacs a year shown on his return, he can have a chance.
Also, a lot will depend on the officer they will get. Some are lenient and some are hard.

It is common for parents to be successful with children's sponsorhsips. So send papers
          and hope for the best.
Since they are all one family, it is advisable for them to apply together.
Applying separately even when traveling together is not advisable at all.
