  • Need Urgent Help on B2 visa

    Hello All,

Need urgent help, on 7th Aug i had an interview at Hyd consulate for B2 visa, unfortunately my visa has rejected.

Here are the list of Questions i was asked and answers given to VO.

1.Why are you going to USA?
    To attend my cousin's daughter's B'day Party.
    2. How long ur cousin's stays in USA?
    since 2005.
    3. WHy did not he invite in this 7 years?
i did not expected this question and i was little nervous to answer this, anyhow i tried to manage with a good answer (at that time my english was not good). VO might have convinced(not 100%)
    4.What do you Do?
    I work for XYZ(MNC) company.
    5. How much you earn?
Around 7 lakhs rupees per annum.
    6.Are you married?
    yes
    7.Do you have a child?
    yes
    8.Are they travelling with you?
    No.
9.Why?(she weirdly asked me this question)
she has to take care my of son as my trip is 3 weeks.

that's all my visa got rejected, As far as my knowledge and analysis question no. 9 was the reason.

SO kindly advise me what is the best answer for this question in the next interview.
I have interview in 2 days. is this answer " my cousin sponsoring only for me " good?
Actually my wife is home maker and i have a 20 months kid. they won't travel with me to USA.

Someone plz advice me ASAP. Thank you All.

First things first. I think you are seen as a potential immigrant because:
    1. Cousin's are not seen as immediate family members. Visa officer will look at them like your friends
    2. If your cousin is so close to you, you should have traveled to the US in the past 7 years which you have not done
    3. Your wife is not travelling because your son is only 20 months old then why are you travelling for 3 weeks leisure trip leaving behind your son and wife

Don't get me wrong but what this does is it shows that you do not have a strong enough reason to comeback to India as:
    1. Your trip is sponsored by your cousin
    2. You don't care for your family

So possibly you are going to the US looking for some job opportunity and then you will call your family there. In fact if you have re-applied for your visa then the chance of success is bleak as it shows that you are desperate to go to the US.

    There are only 2 options:
    1. If you are going ahead with your application then be honest and do not change your answer because previous VO would have made a note of your answer. Just say that your cousin wanted your entire family to be a part of their celebration and was willing to sponsor their trip but because your son is too young to travel both he and your wife are not travelling with you

    2. Cancel your interview and schedule it with your family after a year. Visa fees paid will be valid for 1 year

      ThanQ for your analysis,

Indeed i want to attend the B'day party and moreover i do not want to work in USA since i'm happy here in india, i just want to visit US once. I have been (visiting)traveling other countries from last 2-3 years(maldives, sri lanka, Thailand), last year i have celebrated my son's B'day in Bangkok. Does this International travel history helps me?
is there any chance of asking me the same question again? if i would be asked, can i answer like this, my son is joined in a play school so my wife has to take care of him despite my cousin invites my family.

      Thank you.

Your reasons for travel dont appear reasonable even for a seasoned traveller . Neither is your income strong enough to point that you have a job to which you want to come back to. VOs know that you can get a better paying job in US and anticipate that you might be trying for that. Its hard to believe one travels over 10000 Miles spending over 2-3 Thousand USD leaving ones family behind to attend a Birthday Party of a distant relative and to visit US for Three Weeks. Ideally if you can show a strong steady income
(100,000 INR+ per month) and self sponsorship for entire family it would be easier to get a visa.

Why you cant wait till your child grows up? Why you didnt go when Child was not there? Why the immediate need to travel ? Why leave family behind? Are some of the questions any VO would get suspicious on.

This is my opinion not legal advice.

Your posts show despearation and VOs would easily read it when you are in front of them. Truthfully only you can answer those questions.

You can surely apply but I see very little chances unless you build concrete reason for travel and concrete reasons to come back. Your only reason for coming back is your family which would be negated if you do a B1 to H1/F1/J1/L1 conversion and subsequently call the family over too. Many have done so in the past hence the VOs are wary and would want to scrutinize you more.

You also dont have a very good reason to travel to US, to attend a birthday party is a very weak reason.

I hope am wrong and you indeed get to attend the celebration.

This is my opinion not legal advice.

                thank you raghvi,

I have no choice but to attend an interview because i'm not able to cancel my appointment since we need at least two working days to cancel,
in my case the interview date is 19th Aug.

So help me with an answer how can i overcome about my family not coming with me to USA.

Does this a valid reason? My SON joined in Play school, so he and my wife won't join the party.

Simple advice is to be honest. In your first interview VO asked you as to why your family is not travelling with you.

As I mentioned earlier, VO would have made a note of whatever answer you gave to this question the last time you attended your interview. So if the same question is asked to you this time, your answer cannot be starkly different.

Also, dont dwell too much into this question. Think of how well can you present your case to show that you are gonna come back.

                  Prepare better for questions like:
Why are you travelling to the US?
Merely saying "to attend a Birthday party" will not work

                  What is your income?
Highlight things like investment, property etc.

why are you travelling to the US? i have already mentioned that for B'day party, like you said VO might have noted down this answer, IF i say different answer don't I be caught.

I think one more valid point, my cousin blessed with a baby boy in March, 2013.

Can i Add this point along with B'Day party.

                      Hello Visitors,

I am seeking analysis from you for the below Questions and answers, i am expecting these questions in my next interview(19th Aug) as i failed to answer these at first interview.

Kindly add some additional note to my answers if required.

Note : my answer are honest.

                      Q. Why are you going to USA?
                      A. To visit my Cousin’s family as he is celebrating a combined party for his daughters’ 5th birth day and for his new born baby boy.
Previous Answer : To attend my cousin's Daughter's B'day and for tourism.

note : my cousin stays in USA for 7 years.
                      Q. Why haven't your cousin invite you in 7 years?
                      A. He does invite me every year since the baby is born, but I was busy with building my career and my family relations.
Previous Answer : Today i have an opportunity to visit them, we had a good time when they visited me last time, baby enjoys my company.
(while answering this question i was nervous and my English was poor since i didn't expect this question)

                      Q. Why is your family not travelling with you?
                      A. Actually my son is little young, I don’t think so he can travel for 20 Hrs continuous journey, besides my trip is little shot, It is good opportunity to me to explore some tourist places in america, so I want to visit as much places as I can, I do not want to rush my family while visiting places.

Note : we have a plan to visit Bangkok once again for my son’s 2nd Birthday like we went for his 1'st B'day in December, can i mention this part to VO?

                      Q. Why don't you wait until your child grow?
                      A. No answer from my side yet, advice me in this?

And, can you post expected questions in my case?

                      Here is my profile,
I am 28 years old, married (home maker), have a 20 months child, have international travel history(maldives, sri lanka, thailand),
work for world's leading IT company, earn 7 lakhs per annum, sponsoring by cousin, 21 days stay, B2 rejected 10 days back.

                        Use your common sense, sir.

Who goes to a cousin's daughter's bday party half way around the world? Don't u have better things to do?

                        your very purpose is flawed.

so many people are trying to make you understand in this forum but you do not seem to understand.

                            Q. Why is your family not travelling with you?
                            A. I have a 20 month old son and I don't want him to travel for such a long journey. I plan to revisit with my family after 3 years and by then even my son will be old enough to recognize things and enjoy when we take him to place like Disneyland and Universal Studio.

Yes, I am sorry but you are persistent when everyone is telling you this
                              purpose is flawed.

For success, you must have a purpose that sounds natural.

Your purpose is very unnatural , no one does this. so,
the officer will always think you have a hidden purpose so will never give it to you.
No matter how many times you will apply or give reasons.

                              advice;

1.Wait several months and apply with your wife and kid to VISIT your cousin and US.
                              2. Wait till you can show better income.
