Doubtful about converting from Visitor (B2) to Student Dependent (F2) Visa.

  • Doubtful about converting from Visitor (B2) to Student Dependent (F2) Visa.

    Dear All,

    I am currently studying in the US since september 2012 on an F1 visa. My F1 expires in 2017 but I will graduate in May 2014 . Since I am studying Business, therefor i can only get my OPT for 1 year. I am getting married in January 2014 and my Fiancee has a 10 year multiple entry US visa. Now we are not sure how to proceed once we get married in January next year (2014), whether to bring her to US on her visitor visa and then apply for an F2 once i start working or whether to apply for an F2 in January. What if her F2 gets rejected, would my spouse still be able to come to US on her Visitor visa or does her visitor visa gets rejected too?

    Kindly advise, so that we could start making financial arrangements. I would highly appreciate any help on this matter.

    Getting an F2 at a US embassy/consulate is very unpredictable .
    And they can easily cancel her existing B1/B2 if they will deny an F2.

    So, it is wise for her to use her b1/b2 to come to US
    and decide course of action when inside US.

      Thank you so much for replying back. So does that mean that she continues visiting US on her Tourist Visa till the time my company sponsors for my H1 Visa i.e. October 2015. Do you think there would be any problems her visiting US in and out for almost an year and a half on B1/B2 Tourist Visa.

      I really appreciate your help on this.

        Yes, she can use her visitor visa even after you guys get married.
        But she must use it tactfully . If she stays very long periods like 5-6 months on each visit and comes back too
        frequently , it can be problematic at entry. Especially when she says her purpose as visiting her husband.
        The entry officer must be convinced that her each visit is temporary.
