  • U.S citizen , trying to apply for my minor son for greencard

    hi,

    im a citizen and i got a visa for my son so hes currently in the US but now i want to apply for his greencard. what are the steps i have to take?

    File CONCURRENTLY an I-130 ( immigrant petition for alien relative) and an I-485 ( adjustment of status petition to green card from his current status).




    By the way, what visa is he on and on what basis did he get it?

      he's here on a B-2 visa. i had applied a n-600 form for him and had got the appointment also but couldnt make it to the date so they denied the
      case for abandonement. now i want to reopen the same case, is it possible ?

        I do not understand. N-600 is for citizenship. Does he have claim to US citizenship?
        But first you said, you were trying for his green card.

          i had filed the n600 form 2yrs ago but couldnt make it to the appointment cuz an emergency came up for me out of country so they denied my case ,lack of prosecution,so now that im back i wanted to know if i could bring the file back in motion. i talked to the immigration officer yesterday and she said that its not possible ...plus because my son is here on a b2 visa they wont enroll him in school until he gets his status changed so i need to file for his greencard.i had petitioned for my husband and he has gotten his greencard but i did that through a lawyer and now i wanna do this on my own (kinda on a budjet).
          in the uscis site it says that a child could file for derivative status under a parent that has a greencard file open or has gotten one ... does that seem like a good way to go?

            I think you should talk to a good attorney about reapplying N-600. By the way , what was the basis of his citizenship claim? Why did he not become a citizen when you did?

            Still, if you wish to go for the green card route; go to USCIS.gov and follow this path;

            Home > Green Card > Green Card Through Family > Green Card for an Immediate Relative of a U.S. Citizen

            It tells you everything on how to do it.

              base of citizenship claim was "applying through a citizen parent" but under the child citizen act ,the citizen parent needs to show 5yr evidence of being in the US which 2 of those yrs have to be after the age of 14 ( im 6 months short on that law ). i got the site.thanx. wish me luck
