Going through proper channels

My Ex wife and I have decided it would be best to go through the proper channels for bringing my son to the States. We have been planning a trip for him over Christmas, once we file the paperwork is he allowed to travel? I don't remember from my time waiting.

Visa waiver like a visitor visa requires non-immigrant intent.
Once an immigrant petition for him has been filed, his immigrant intent
is obvious , so he could be stopped travelling on the visa waiver if this
info shows up on the inspector's computer at entry.
