  • b2 visa question

    hello,

I need to ask two questions about the b1/b2 visa.

1, firstly my daughter went to USA on a b2 visa to attend a family wedding ceremony for the first time, there she met some boy and they soon to got engage and now they want to marry, Is my daughter breaking a US law by marrying on b-2 visa. she didn't entered the US for purpose of marriage but now she is marrying.

2, now as father, i wish to attend this marriage. i will go with my wife only (she already has a visa). we wont take our other children along with us as it it is impossible for them to get visa after what their sister did. Now can i apply for a b-2 visa for this purpose or should i refrain from applying due to the complex nature of this case.

your guidance will be highly appreciated. thank you

My age is 53 years. you ask for other details as well.

    Hello, Sir.

I will reply to the part that i understand, for the rest, maybe some of the experienced members can help.

About breaking US law on B2 Visa - To my understanding, there is no law prohibiting people to marry on B2 Visa. Ofcourse, it is not liked that people enter for Tourism (B2) purpose and then marry. The Visa Officers are on the lookout for such cases (Potential Immigrant / Eligible Bachelors) at the time of granting visas.

Now, if this boy is a Citizen, he can file for your daughter's Green Card once they are married. She will be issued a Conditional Green Card, and 2 years later she could get the conditions on Green Card removed (which is a standard procedure for issuing Green Cards based out of marriage).

I do not know the answer about your visa eligibility or the eligibility of your other children. Perhaps, some experienced member could share your thoughts.

I am not a professional, these are my personal thoughts.

Wishing your daughter a blissful marital life.

    Cheers,

      Dear Sir,

I may humbly take the liberty of disagreeing here, to the extent that if the marriage with a U.S. Citizen is bonafide and the couple does not split for some years, there is little the US authorities can do about it.

The authorities are free to not like it, but if the marriage to a US citizen is bonafide, the case is good.

This is my personal opinion, based on my experiences. I am not an attorney.

      Cheers,

End of the day it is the job of the US consulate to keep you out of the country especially when potential immigration is yr ultimate aim under the guise of tourism
