Hi there,
I am hoping someone can help with my question...
I am a particularly honest person, so when I noticed the rules for applying for the VWP I took note.
ANY caution had to be declared for crimes of moral turpitude.
Now I have never been in trouble with the police, but as a teen my husband was arrested and cautioned for getting into a fight that resulted in a bit of fisticuffs and nothing more. He was not the instigator but was taken back to a cell to 'cool off' before being released again.
So, I had my husband declare this to the US embassy. He had to go to London for an interview and was granted a B2 Visa.
Now we arrived in the USA on vacation and he was taken to be interviewed by officials. After his interview he rejoined me in collecting our luggage and told me that the official interviewing him told him that was not considered a crime of moral turpitude and that he needn't have gotten the B2. That he could have travelled on the VWP.
My question is, when the B2 comes up for renewal do we have to apply for it again? I mean now we have had it once. Or could he return to travelling on the VWP?
I feel such an idiot for getting him to go through what was months and months of worry, money and embarrassment to obtain the B2 in the first place. Especially as it was obviously such a long time since he received that caution and has not been in trouble with the law since.
As a born worrier, your advice is most gratefully appreciated.
Many thanks
Reef
