Urgent Query on Visitor Visa

Hi,

I am currently in US and my H1B got extended recently.. Can I apply for visitor visa for my parents in India. My stamped visa shows expiry .. Do I need to get it stamped and then apply for my parents visa or a valid I 797 copy will work in this case?

Gaurav,

You cannot petition your parents for either a visitor (B2) or immigrant (IR-5) visa. Visitor visas do not allow petitioners. The applicants must apply on their own evidence of having to return before the visa is expired.

You must be a U.S. citizen to petition parents as immigrants.

Thanks .. But I can sponsor my parents as well right? My query is Can I sponsor my parents in this situation where being in US where I have a valid H1 B with I797 but not a valid stamped visa.. Can I sponsor my parents to come in January 2014.

There are no provisions for sponsorship of visitor visa entrants. But sponsors of immigrants must provide proof of either U.S. citizenship or Permanent Resident status, as well as being at least 21 years old.
