    Self and my Wife Came to US on B 2 Visitor's visa on June 28 , 2013 with* I 94 stamped date being Dec 27, 2013 . We hv a return tkt to India for dec 20, 2013. Howver, my wife has to extend her stay on medical grounds till Mar 31, 2014 and in this regard, we hv sent the I 539 Forms , Visa fee, Financial support docs , return air tkt for Feb 1, 2014 and relevant medical certificate to USCIS - Vermont service centre on Oct 24, 2013 and the same was recd by them on Oct 26 th at 2:14 P.M . However , we hv not recd the appln receipt no so far . How much time it takes normally to receive the appln receipt no and the approval thereof. On enquiry with customer care no, we were told that they are processing applns now dated Apr 17, 2013 and we are not sure whether we will get the receipt no and apporval atleast by Dec 15, 2013 so that we can decide on staying further or not. Also whether , the appn receipt no is valid for staying beyond the I 94 stamped date* w/o waiting for approval for stay and is it legal. My wife's stay is critical here atleast upto Feb 1, 2014 and hence we hv booked her tkt for Feb 1, 2014, though we hv asked for 3 months extn upto Mar 31, 2014 .to be on safe side.Could You Pl inform reg the above and any help on how to pursue may be of great help.

    Extension responses take 2-4 months to come , so if you applied recently, it will come after your stay expires.
    If you have the proof of filing I-539 and paid fees, you are legal till the response comes. But if it is a denial, you will have to leave
    immediately as you will beome out of status. The next time you enter US, you will have to carry extension denial papers.
    If your wife's extended stay is that important, you should stay on. Keep a proof of filing an I-539. Hopefully it will be an approval.

      Dear Member,

      Thanks for your response . Is the application receipt no is the proof as we hv sent it by USPS and on enquiry, we hv got a voice response that the same was delivered on Oct 26 th at 2:14 P.M in vermont Office . So.should we receive atleast the appln recipt no which you are saying can be a prrof of having submitted the I 539 from with fees and if so, will USCIS send the same atleast by Dec 15 th to decide on staying or not as we hv a valid return tkt for Dec 20 th .Kindly inform and would appreciate your response or from other forum members as well on this.
