  • Urgent Case, Need advice on B1/B2 visa application.

    Dear Friends,

Me and my wife are Singapore citizen, We encountered problem while applying the B1/B2 visa on last week.

We had been visiting U.S for 4 times in past few years on VWP, the duration for each stay was about one month. This Year, we planned to have a long vacation for about five month (we will spend about one month to visit friend and have a tour in Canada), so we decided to apply B1/B2 VISA instead of to use the VWP. Due to my overconfident, i didn't prepare any current bank-statement and employment letter during the visa interview, so the VO kept on questioning me on the jobs as well as where is the funds to cover up our expenses in the U.S ( In fact,i only prepared the Tax paper for both of us to show him, combined income was nearly $90K USD for past year), i did explain that we will be staying with our family, the accomodation, food will be covered by them, but the VO looks like not believe what i said to him, unfortunately, at the end of the interview, he passed us a yellow form (221g) to request for additional docs:: Past three month payslip / Past three month bank -statement/ Employment letter to show our ongoing employment.

when we stepped out the embassy, both of us felt extremely sad,Becoz we never encountered any situation like this B4. But what to do?

so today, i went to collect the pay-slip and employment letter from our employer, another thing is, we dun have much saving reflected on our bank-statement, i also just topped up the saving account to around $14500USD. For the three month payslip, due to our job nature is self-employed basis ( Real estate business), my last three month gross commision received is ard$17600USD ( credit to the same saving account), but my wife actually didn't transact any case for past three month, so basically there is no income for her.(other than the 1k USD rental income every month from our flat)

we plan to submit the required docs to the VO asap on next week, i dun know whether he will accept our income docs or raise any furthur question to grill me on the spot. but now at least i already prepared to answer him where is the saving suddenly come from. Furthermore, i also requested my mom to send me an invitation letter 2gether with her U.S bank account statement to show the VO if neccessary ( she is a green card holder).

So my dear friends, i need ur advice urgently b4 go down to the embassy next week. Is the $14500USD will not enough to show the VO? and i just credit ard $11k USD to my saving account after the visa interview, is there any problem with that? the Good thing is: we had been travelling to Canada/Austrialia/Japan and many Asia countries in the past few years and never go against any immigration laws, we also have our own flat and car in singapore, sure will return after the vacation.

Pls help me, and Your any advice is greatly appreciated.

    Benson.

Actually they are looking for regular employment and regular income that will bring you back.
that is why he asked for employment papers and income papers.

yours seems to be a commission based real estate work and earning.
Just take a strong letter from your employer that you have been established in this line of work for
xxxtime and this is ongoing. You will need to do some convincing to the officer about your
nature of work and income as there is no regular pay slip and you will have to show
where that top up came from.

Actually, during the visa interview, the VO already pointed out that our jobs is classified as an independent Contractor, however, the employment letter i requested from my employer has clearly indicates the join date and the senior position i am holding now. ( In terms of Ranking). furthermore, we are holding a individual liscence from the goverment body to engage the work in real estate, which the liscence now require an specific exam, knowledge and money to obtain. i will try to use this point to convince the VO about our jobs.

So now, a bit tough to convince the VO about the fund, but is there any income guideline to follow? Many thanks-

I am in India so I do not know about singapore income guidelines.
But common sense tells me , showing an IT return of 90k USD per year should have satisfied the income requirement.

I think what they need is a confirmation that you have ongoing employment, something you did not have the first time.
Plus bank statements to see you have money coming in.

Can't you take receipts of recent commissions you were paid , if your bank account is only showing the top up you just made?

Thanks- for the income slip, I already requested my employer to break down into cases to show the past three month commission received, I also no problem to proof to the VO about our saving account's regular activities, like incoming commission /outgoing bill payment. Just becoz normally we only maintained a very low balance in our account. So I am not sure whether the VO will accept my explanation, but to show them the available fund for the U.S travel is the best thing and only thing I can do now.
