  • Visitor Visa for In-Laws

    Hi - I am applying for Visitor Visa for my In-Laws second time. They applied visa first time in May 2011. Few questions they asked first time are as below:
    Question to Father in Law:What do you do?
    A:Building Contractor
    Question to Mother In Law: What do you do ?
    A: House wife
    Question to Father in Law: Who you are going to visit and what he work:
    Answer: visiting daughter and son-in-law. My son-in law is software engineer.
    Question to Father in Law: Have you gone out of country before?
    A: No

    After this consular concluded and said you cannot go now.

    After this rejection , they went to UK 2 times on visitor visa to visit his brother and came back to India within 20 days. They still have UK visa and planning to come again and also want to try for USA again.

    My wife is their only child and she is on H-4. I am on H-1 and full time employee with USA company for last 7 years and our GC application also filed. They do have property(Home/Land) in India. Also he got 5 year contract for construction for a company in India. He is also president of local temple in village.

    Can you please suggest what else should we consider to make their case strong so that there are good chance of them getting the visa this time.

    They read most of the info on the DS160 form , that is why they asked very few questions.

    The likely reason for denial is 'only child in US'.

    Did you sponsor their visit last time? Meaning , did you send an I-134?

    And how much income did your FIL show on the form last time? ( roughly)?

      Hey - Thanks for you quick reply! I think we cant do anything for only child :-) Also , I don't think we mentioned anywhere on the DS-160 about the only child and consular didn't asked about that too. and yes I did send I-134 form showing my income i.e. around $90k/year at that time but consular did not asked about that. And we mentioned In-laws income on form i.e. around INR 20-25K/month. Also on DS-160 we answered that my In-laws will pay for their trip thinking that will make it strong. Not sure if that could be reason for denial ? And we mentioned their Occupation as "Other" category with detailed explanation. Should it be "business" instead?

        ok. so your sending the I-134 did not matter. The officer did not ask for it because in the form they mentioned the opposite ; self funding.

        When you are sending the I-134 it should be mentioned in the form that , the host , will be funding.

        Although self funding always goes in the applicant's favor but one must have good income for it. Here they showed self funding
        but the income they mentioned was only 25k /month which is very low. Also , the officers look at the income figure as a financial tie to India.

        Hence the reason for denial was the income figure.

        If he is actually earning only 25k as a building contractor, then the next time you should mention that you are funding and send an I-134 again.
        But , again they may ask them the income during the interview and no. of children they have and it can again be a negative outcome.
        That said, there is nothing else they can do except to attempt again with your I-134 and hope for the best.
