  • Visa for Mother in Law, help URGENT

    Dear members,

I am expecting to be a father soon and am sending paperwork to help sponsor my mother in law to visit for a month during the time of the delivery. However, I don't know the right procedure and proper documents needed, and how to apply for her. She applied a few months ago to see my reception but without any supporting documents, she was rejected..

I have a relative leaving to India, so i will be sending these documents with notarization to get to my mother in law.

    Copies:
My passport, OCI, citizenship, Social Security, Drivers License, birth certificate.

Wife's Passport, Visa, Green Card, Social Security, Drivers License,.

    Originals
Mine: Job letter, Bank Letter, Tax Return
Hers: Pregnancy Letter, Marriage Certificate, Birth certificate.
Letter to consulate, Invitation letter, & Form I-134.
    -----

The small issue is that my income is not enough to show that i can bare my mother in laws expenses, etc.. should I include my mother as co sponsor, and have supporting documents for hers sent as well?

We will start the application process next month, but want to get all the necessary paperwork's in her hands.

I wanted to know exactly what documents she should be taking on her end to the embassy, and what kind of visa application would this be?

The right visa for her will be a visitor visa ( B2).

Visitor visa decisions involve officer judgement on the applicant's life situation ( ties to home country)
more than the documents sent by the host.

    Please post;

    1. Her family ties at home ( husband and any children besides your wife)
    2. Her husband's income.
    3. is she working or not? her income if working
    4. Please post the last interview whatever she can recall. It is important .

She has in total, two daughters and one son.. her son is handicap and suffering from epilepsy, age 20. needs her care, or servant supervision.
Her other daughter is married to a major in military post.

She works, and makes around 80 thousand rupees monthly. govt job. * took NOC last time, and will again this time. *

N her husband died 3 years ago..

My wife applied for her with no visa application(tourist visa) knowledge, before she was coming to USA for her to come as a tourist to see our reception.

They asked, Where will you go? she said my daughter is there, etc. then asked about me, n my mother in law with not much knowledge of addresses etc said i have a motel here etc. n asked about income etc, she said that she didn't bring any documents. and a few minutes later they rejected her saying she has no proof.

But now we want to apply for her to see the birth of her grandchild.

Ok. she is a widow and your wife's pregnancy. Both the situations the visitor visa is difficult if not impossible to get.
Widowhood because they think there is no husband to bring her back and
pregnancy because they think Indian parents replace american nanny care during pregnancy.

Anyway, she should try again and show self funding of the trip as she is earning very well. That is important . In the form DS 160 there is a question
"who is funding the trip' write 'self ' as the answer.

Your wife needs to send an invitation on her letterhead, a copy of her visa . There is no need for your income papers as she is self funding.
But she should know and carry some proof of what you are doing.

She should also carry her income proof with her NOC. ( tax return, salary slip)

I hear that it is difficult to get visa bc of her being a widow, but she has a dependent son who is 20 and handicap.. needs her, so she can't stay for long plus she works in a government job. also having over $250,000 dollars worth of property. if she takes documents like her bank account, property ownership, her son's medical condition records. would that help as well?
