Hi, I returned from usa in 2011 on k1 visa as things didnt workout. I stayed there for only 89 days and now planning to apply for tourist visa again. What kind of question visa officer can ask me, is there a chance of getting a visa again. I have decent travelling history. I have been London and Singapore on tourist visa. Will appreciate your advice. thanks

You did not violate any laws during your K1 visit that is ok
But it does show you had intent to immigrate in the past , so
success will depend on your current situation and how strong ties to home you show.
MAIN POINTS; single or married, purpose of visit ( business or pleasure), if pleasure ( is it visiting relatives or plain tourism), going alone or with someone,
work at home ( stability of job or business), income ( very important). Duration of visit requested.Last edited by peace999; 12-31-2013, 07:30 PM.

A subsequent nonimmigrant visa application after a K1 which was not completed is sometimes met with suspicion by interviewers. If another K1 is being applied for within a year or two of the first K1 failure, you may be targeted by some interviewers as "shopping" for a Green Card (and denied for "multiple" petitioners).
It would be wise to have a very good explanation for wanting a visitor visa, since your previous K1 incomplete will be a discussion issue during the interview.

Thanks for the replies. I was filing up ds160 form n there was a question that "has someone filed an immigration petition for you with uscis" as my ex fiance has filed i-129f for me. So shall answer it yes or no as k1 visa is a non immigrant visa. Please advice

good question. though technically a non-immigrant visa, it leads to immigration. It does not matter actually because there is this other question
about have you ever been to US on what visas, so you will have to declare you had K1 and an immigrant intent in the past.

Since a K1 petition is handled much like an immigrant petition, it is a good idea to respond "yes" that question. Or answer "no," but include a separate attachment referencing the question and explaining that there was a K1 petition.

My monthly income is rs 36000 is it good. I m just going alone n paying myself. I booked a hotel for 6 nights @Rs 18000. Shall i also book confirmed air tickets in advance. Will it be plus point. N after reading all my posts do i hv chance to get a visa.

Nobody can accurately predict the outcome of your visitor visa application. What you have done so far will probably look good to the interviewer.

income is not good for the visa. And past K1 history shows immigrant intent. I would not give it a good chance . No need to book hotel or tickets , it does not
make any difference.
BTW what is your purpose of visit and duration of visit. any relatives in US?

Purpose of visit is tourism i m planning to visit new york. Its a beautiful city, nice weather, sight seeing and great food. Duration is one week only as i have only one week approved leaves. No relatives now. How much would be nice income for an individual. Thanks

going alone for tourism on 36000 income with a history of K1; I would strongly advise against applying.
You would be wasting your money and time.
For tourism, first of all, do not go alone.
Genuine tourism always means with someone , family or close friends.
And secondly, you need better income at least 80k plus.
